Terms and Conditions

Last updated: 7 September 2026

1. About these terms

These Terms and Conditions apply when you use namastegozo.com or buy products from Namaste Gozo through the website. They form a contract between you and Namaste Gozo when we accept your order.

Namaste Gozo is a sole trader established in Malta, VAT No. MT25895008, with its business address at 79 Triq Gorg Borg Olivier, Il-Mellieħa, MLH 1022, Malta. You can contact us at namastegozo@gmail.com or +356 77129722.

If you are a consumer, these terms do not limit rights that cannot lawfully be excluded under the law applicable to you.

2. Eligibility and acceptable use

You must have legal capacity to enter a contract or act with the involvement of a parent or legal guardian. You may use the website only for lawful purposes. You must not interfere with its security or operation, introduce malicious code, scrape it in a way that imposes an unreasonable load, misuse another person's account, or use content in violation of intellectual-property rights.

3. Products and information

We sell clothing, including bras and other garments, handicrafts and related products. Many items are handmade or produced in small batches. Minor differences in colour, pattern, texture, measurements and finish may occur and are not defects where they are inherent in handmade or natural materials. Screen settings may also affect colour display.

We aim to describe products accurately, including material or fibre composition where required. Measurements and fit guidance are approximate unless stated otherwise. Product availability is not guaranteed until we accept the order. We may correct genuine errors before acceptance and will contact you if a material correction affects your order.

Any origin, artisan, natural-material, sustainability or ethical-production statement applies only where supported by the relevant product information. Care instructions and safety warnings supplied with a product must be followed.

4. Prices, taxes and promotions

Prices are shown in the currency selected on the website. Taxes included or added, delivery charges and the total payable will be shown before you place the order, to the extent required by law. For delivery outside the European Union, the recipient may be responsible for import VAT, customs duties, clearance charges and local taxes unless checkout expressly says they are included.

Discounts and promotional conditions will be stated with the offer. Where EU price-reduction rules apply, the displayed prior price will be determined as required by law. Obvious pricing or calculation errors do not oblige us to supply at an incorrect price; we will give you the choice to confirm the corrected price or receive a refund.

5. Orders and contract formation

Your checkout submission is an offer to buy. An automated acknowledgement confirms receipt, but acceptance occurs when we send an order-acceptance or dispatch confirmation, or otherwise clearly accept the order. We may decline or cancel an order before acceptance for legitimate reasons, including unavailable stock, failed payment, suspected fraud, delivery restrictions or an obvious error. If payment was taken, we will refund it.

Please check your delivery and contact details before ordering and notify us promptly of an error. We cannot guarantee changes after dispatch.

6. Payment

Available payment methods appear at checkout and are processed by the relevant payment provider. You authorise the total shown at checkout and confirm that you may use the selected method. Title to products passes after full payment, subject to mandatory law. Risk passes as described in the delivery section.

7. Delivery

Delivery options, costs and estimates are shown at checkout where available. Estimates are not guaranteed delivery dates unless expressly agreed. We will deliver without undue delay and within any mandatory legal deadline. If we cannot meet an agreed essential deadline, your statutory remedies remain available.

For EU consumer deliveries, risk generally passes when you or a person you nominate, other than the carrier, takes physical possession, unless you independently commissioned a carrier we did not offer. For other deliveries, mandatory local rules apply. International orders may be delayed by customs or local authorities. You are responsible for accurate delivery information and lawful import of the products.

8. Cancellation before dispatch

Contact us promptly if you wish to cancel. If the order has not entered fulfilment, we will try to stop it. If it has already been dispatched, the withdrawal and returns provisions below apply.

9. EU/EEA/UK consumer withdrawal rights

Where distance-selling law grants a right of withdrawal, you may notify us within 14 days after you, or a person you nominate, receives the goods, without giving a reason. For multiple goods delivered separately, the period generally runs from receipt of the last item where the law so provides.

Send a clear withdrawal statement to namastegozo@gmail.com with your name, order number, products concerned and contact details. You may use this model wording:

I notify you that I withdraw from my contract for the sale of [product], ordered on [date] and received on [date]. Name: [name]. Address: [address]. Date: [date].

After notifying us, return the goods without undue delay and no later than 14 days, unless we arrange collection. You normally pay the direct return cost unless we agreed otherwise, failed to give legally required notice, or the item is faulty or incorrect. Use suitable packaging and retain proof of posting.

We will refund payments required by law, including the standard outbound delivery cost where applicable, using the original payment method unless agreed otherwise. We may withhold the refund until we receive the goods or evidence of return. We may deduct for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The statutory withdrawal right does not apply where a legal exception applies, including:

  • goods made to your specifications or clearly personalised;

  • sealed goods not suitable for return for health-protection or hygiene reasons once unsealed after delivery; and

  • other categories excluded by mandatory law.

For clarity, a bra or intimate garment is not automatically excluded. The hygiene exception is relied on only where the item was supplied sealed, is genuinely unsuitable for return for health or hygiene reasons, and the seal was broken after delivery.

10. Faulty, damaged, unsafe or incorrect goods

Inspect your order and contact us promptly if an item is damaged, unsafe, incorrect or not as described. Provide the order number and reasonable evidence, such as photographs, where possible. Your legal guarantee and conformity rights are separate from the 14-day withdrawal right. Nothing in these terms excludes repair, replacement, price reduction, refund or other remedies required by applicable consumer law.

Do not continue using a product that appears unsafe. Contact us and follow any recall or safety instruction we issue.

11. Voluntary returns

Any return option we voluntarily offer beyond statutory rights will be described in our Refund Policy or communicated to you. Voluntary conditions do not reduce mandatory rights.

12. Customs and international orders

You are the importer of record where local law treats you as such. You must comply with import restrictions and pay duties, taxes and fees not included at checkout. Refusal to pay lawful import charges may result in return, abandonment or destruction of the parcel. Any refund may be reduced by non-refundable charges or loss to the extent permitted by law. We do not promise that every product can lawfully be imported into every destination.

13. Accounts, reviews and submitted content

You are responsible for account activity and for keeping credentials confidential. Reviews must reflect a genuine experience and must not be unlawful, deceptive, abusive, infringing or promotional spam. If you submit content, you retain ownership but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and adapt it as reasonably necessary to operate and promote our business, subject to privacy and consumer law. We may moderate content for lawful reasons but do not promise to monitor all content.

We will not claim that reviews are verified unless we have taken reasonable and proportionate steps to verify them. Incentivised content will be disclosed where required.

14. Intellectual property

The website and its original text, branding, layout, photographs, graphics and other content are owned by or licensed to Namaste Gozo and protected by applicable law. No rights are transferred except the limited right to use the website for personal shopping. Third-party trademarks remain their owners' property.

15. Third-party services and links

Shopify and other providers supply parts of the website, checkout and payment process. Third-party links and services may have separate terms and privacy notices. We are responsible for our own obligations and do not control independent third parties.

16. Liability

We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, deliberate misconduct, or mandatory product and consumer rights.

Subject to that rule, if you are a consumer, we are responsible for foreseeable loss or damage caused by our breach or failure to use reasonable care. We are not responsible for loss that was not reasonably foreseeable, for business loss arising from a consumer purchase, or for delay or failure caused by events outside our reasonable control, except where mandatory law provides otherwise.

If you buy wholly or mainly for business purposes, additional limitations may be agreed separately. Nothing on the website is professional, medical or safety advice.

17. Events outside reasonable control

We are not responsible for delay caused by events outside our reasonable control. We will take reasonable steps to reduce the effect, inform you where appropriate and perform as soon as reasonably possible. Your mandatory cancellation or refund rights remain unaffected.

18. Privacy

Our Privacy Policy explains how we handle personal data. Cookie choices are available through the site's privacy controls.

19. Changes to the website or terms

We may update these terms for future use because of legal, security, operational or service changes. The terms in force when we accepted your order normally govern that purchase. We will not retrospectively remove accrued mandatory rights.

20. Governing law and disputes

These terms and non-contractual obligations are governed by Maltese law. If you are a consumer resident elsewhere, you retain any mandatory protection given by the law of your habitual residence and may bring proceedings in any court available to you under mandatory jurisdiction rules.

Please contact us first so we can try to resolve a complaint. You may also contact the Malta Competition and Consumer Affairs Authority or an applicable approved alternative-dispute-resolution body. The former European Commission Online Dispute Resolution platform is no longer operational, so these terms do not direct consumers to it.

21. General terms

If a court finds part of these terms unlawful or unenforceable, the remaining parts continue to apply. A delay in enforcing a right does not waive it. You may not transfer your contract without our consent, but we may transfer it as part of a legitimate business transfer provided your rights are not reduced. No third party may enforce these terms unless mandatory law says otherwise.
